Consequences of non-compliance

Whilst compliance with export control is a shared responsibility, it is the responsibility of the Principal Investigator (PI) or key contact for the activity to ensure compliance with export controls before engaging in any research or exporting a controlled item.

Non-compliance, either by not obtaining a licence or by breaching the conditions of a licence, is a criminal offence and penalties can vary depending on the nature of the offence. These include:

  • Revocation of export licence
  • Seizure of items
  • Unlimited fines
  • Imprisonment for up to 10 years
  • Disciplinary action in accordance with relevant University policies
  • Termination of contract
  • Reputational damage to the University and yourself

The ECJU publishes details on their notices to exporters (information on the gov.uk website) regarding 'compound penalties/settlements' which have been given for non-compliance with export control legislation.
